1. About these terms
These Terms of Service ("Terms") govern your use of the Bundle marketplace, operated as a sole trader under the registered business name LETSBUNDLE (ABN 47 119 307 431) ("Bundle", "we", "us", "our") at letsbundle.online and any related applications and services (the "Platform").
By creating an account or otherwise using the Platform, you agree to be bound by these Terms, our Privacy Policy, our Refund & Dispute Policy, and our Acceptable Use Policy. If you do not agree, you must not use the Platform.
We have written these Terms in plain English where possible. They are still a binding contract.
2. What Bundle is — and what it is not
Bundle is a marketplace. It is not the seller and it is not the buyer.
The Platform exists to help people moving out of a property in Sydney connect with people moving in, so that furniture and household items can change hands in a single transaction (a "Bundle") rather than being disposed of or sold piecemeal.
- Bundle is a venue and matchmaker. We are not a party to the transaction between a seller and a buyer.
- Bundle does not take possession of, inspect, store, repair, or transport any goods.
- Bundle does not warrant the condition, quality, safety, accuracy, legality, or value of any item listed.
- Bundle holds buyer payments until they are released to the Seller. Deposits and payments are paid to Bundle and processed by Stripe, our third-party payment processor. At certain points in the transaction — including during the Defect Window described in our Refund & Dispute Policy — Bundle holds funds in its account with Stripe before they are released to the Seller.
- Identity verification confirms a user's identity only. It does not vouch for character, intent, reliability, honesty, or future conduct.
The transaction for the goods is between the seller and the buyer. Bundle's role is to facilitate that transaction and to operate dispute resolution mechanisms as described in our Refund & Dispute Policy.
3. Eligibility
To use the Platform you must:
- Be at least 18 years old
- Be a resident of New South Wales, Australia (we may open other regions in future)
- Be legally able to enter into a binding contract
- Complete identity verification through our trusted third-party identity verification provider
- Provide accurate, current and complete information when registering and keep it up to date
We may refuse, suspend, or terminate access at our discretion where these requirements are not met or where we reasonably believe the Platform is being misused.
4. Your account
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Notifying us immediately at hello@letsbundle.online if you suspect unauthorised access
You must not share your account, create multiple accounts to circumvent restrictions, or impersonate another person.
5. Identity verification
All users must complete identity verification before they can list items, lodge a deposit, or transact on the Platform. Verification is performed by a trusted third-party identity verification provider and typically involves a government-issued ID and a selfie with a liveness check.
You consent to your information being shared with the verification provider for this purpose. The verification provider returns to us only a verification outcome and a reference. The handling of your information is further described in our Privacy Policy.
Verification confirms identity only. It is not a guarantee of any user's honesty, reliability, or fitness to transact. You remain responsible for your own due diligence before agreeing to buy from or sell to another user.
6. Seller terms
If you list items on the Platform (a "Seller"), you represent and warrant that:
(a) You own the items outright or have full legal authority to sell them, and they are free of any third-party claim, lien, or security interest.
(b) Your listing is accurate. Photos are of the actual items. Condition, age, and material descriptions are honest. Material defects are disclosed. Where Bundle upholds a buyer dispute that the items materially differed from the listing, a Mis-listing Fee applies as set out in Section 8 and our Refund & Dispute Policy.
(c) The items are legal to sell under New South Wales and Australian law, and are not on the list of prohibited items in our Acceptable Use Policy.
(d) You will honour confirmed bookings. Once a buyer has lodged a deposit and a collection date is agreed, you will hold the items for that buyer, make them available on the agreed date, and not relist or resell them.
(e) You will provide a safe collection environment and not unreasonably obstruct collection.
(f) You will not solicit or accept off-platform payment to avoid Bundle's service fee, contact buyers off-platform before a deposit is lodged, or otherwise attempt to circumvent the Platform.

7. Buyer terms
If you lodge a deposit or purchase a bundle (a "Buyer"), you represent and warrant that:
(a) The listing is the basis of the transaction. The photos, descriptions, and disclosed condition in the listing are what you are buying. You are entitled — but not required — to inspect items in person at the collection point. Where items materially differ from the listing, our Refund & Dispute Policy sets out how to raise a dispute, including a Defect Window after collection.
(b) You will turn up. Once you lodge a deposit and a collection date is agreed, you will attend at the agreed time or give reasonable notice if you must reschedule.
(c) Collection is your responsibility. Bundle does not transport goods. You must arrange your own transport, helpers, lift bookings, and any necessary equipment.
(d) You will not attempt to circumvent the Platform by contacting the seller off-platform before a deposit is lodged, or by negotiating a side deal to avoid Bundle's service fee.
Where you fail to honour a confirmed booking, our Refund & Dispute Policy applies.
8. Fees, deposits and payments
Service fees
Bundle charges a service fee on each transaction. Service fees are disclosed before you confirm a transaction. As at the date of these Terms, service fees are less than 10% on each side (seller and buyer). Service fees may change — we will give notice of any change before it applies to your transactions.
Deposit
Buyers lodge a 10% deposit to confirm a booking. The Deposit is a deposit paid as an earnest of the Buyer's commitment to complete the transaction — not a part-payment held on account. It is 10% of the agreed Bundle price. Where the Buyer completes the transaction, the Deposit is credited toward the Balance and forms part of the price paid. Where the Buyer fails to complete without cause, the Deposit may be forfeited in accordance with our Refund & Dispute Policy. Where the transaction does not complete for a reason that is not the Buyer's fault — including a defect in the goods, Seller cancellation, or Seller no-show — the Deposit is refunded in full.
The Deposit is held by Bundle in its account with Stripe. Conditions for refund, partial refund, or forfeiture of the Deposit are set out in our Refund & Dispute Policy.
Balance payment and payout timing
The balance owing for the items is paid by the Buyer through the Platform on the Collection date. Stripe processes the payment and Bundle holds the Seller's payout during the Defect Window set out in our Refund & Dispute Policy. After the Defect Window closes — and subject to any deductions for refunds, the Mis-listing Fee, or other amounts payable under our Refund & Dispute Policy — the payout is released to the Seller, less the service fee and any agreed holdback.
Mis-listing Fee
A flat AUD$200 Mis-listing Fee applies where Bundle upholds a dispute under our Refund & Dispute Policy that the items materially differed from the listing. The fee is a genuine pre-estimate of Bundle's cost of arranging disposal of the affected items and administering the dispute — it is not a penalty. The fee is deducted from the Seller's held payout, or charged to the Seller's saved payment method where the held payout is insufficient.
GST
Where Bundle is required to collect GST on its service fees, GST will be shown separately on your invoice. Sellers are responsible for their own GST obligations on the sale of their goods.
9. Address reveal
To protect Seller privacy, the Seller's collection address is withheld until the Buyer's deposit is confirmed. Once the deposit is confirmed, Bundle will release the address to the Buyer through the Platform. Bundle records the time of release for dispute resolution purposes.
10. Cancellations, refunds and disputes
Cancellation, refund, and dispute mechanics are set out in our Refund & Dispute Policy, which forms part of these Terms.
11. Prohibited conduct
You must not, and must not attempt to:
- Use the Platform for any unlawful purpose
- List anything prohibited under our Acceptable Use Policy
- Circumvent service fees by transacting off-platform
- Misrepresent yourself or your items
- Harass, abuse, threaten or discriminate against other users or Bundle staff
- Probe, scan or test the security or integrity of the Platform without our written permission
- Use bots, scrapers, or automated tools to access or interact with the Platform
- Reverse engineer, copy, or build a competing service from the Platform
Breach of this section may result in suspension or termination of your account and may be reported to law enforcement.
12. Intellectual property
Platform
The Platform — including its design, code, branding, the "Bundle." word mark, copy, and underlying technology — is owned by Bundle or licensed to us. You may not copy, modify, distribute, or create derivative works without our written permission, except as permitted by law.
Your content
You retain ownership of the photos, descriptions, and other content you submit ("User Content"). By submitting User Content you grant Bundle a non-exclusive, worldwide, royalty-free, transferable, sublicensable licence to host, store, reproduce, modify (e.g. resize), and display the User Content for the purpose of operating, promoting and improving the Platform. This licence continues for the period your content is on the Platform and for a reasonable period afterwards for backup and dispute-resolution purposes.
You warrant that you have all rights necessary to grant this licence, and that your User Content does not infringe the rights of any third party.
13. Disclaimers and consumer guarantees
To the maximum extent permitted by law, Bundle provides the Platform "as is" and makes no warranty that the Platform will be uninterrupted, error-free, secure, or fit for any particular purpose.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) that cannot lawfully be excluded.
Where Bundle's services to you are subject to consumer guarantees under the Australian Consumer Law, and to the extent permitted by law, Bundle's liability for breach of those guarantees is limited to:
(a) re-supply of the services; or
(b) payment of the cost of re-supplying the services.
For the avoidance of doubt, Bundle does not provide any warranty in respect of the goods sold by Sellers on the Platform. The Seller is the supplier of the goods. The Australian Consumer Law guarantees apply to the supply of goods by the Seller and are between the Seller and the Buyer.
14. Limitation of liability
To the maximum extent permitted by law, and subject to consumer guarantees that cannot lawfully be excluded:
(a) Bundle is not liable for any indirect, incidental, consequential, special, or punitive loss or damage, including loss of profits, loss of revenue, loss of data, or loss of goodwill, arising out of or in connection with your use of the Platform.
(b) Bundle's total aggregate liability to you arising out of or in connection with these Terms or your use of the Platform — for any cause and on any basis — is limited to the greater of (i) the total service fees you have paid to Bundle in the twelve (12) months immediately preceding the claim, or (ii) AUD$1,000.
This limitation applies even if Bundle has been advised of the possibility of such loss or damage.
15. Risk of in-person meetings
Bundle facilitates transactions that involve users meeting in person at a Seller's address. You meet in person at your own risk. Bundle does not screen users beyond identity verification and does not supervise meetings.
We strongly recommend you:
- Bring a friend or helper to collection
- Schedule collection during daylight hours
- Tell someone where you are going and when you expect to return
- Trust your instincts and leave if a situation feels unsafe

16. Indemnity
You indemnify Bundle, its officers, employees and contractors against any loss, damage, liability, claim or expense (including reasonable legal costs) suffered or incurred arising out of or in connection with:
(a) your breach of these Terms, the Privacy Policy, the Refund & Dispute Policy, or the Acceptable Use Policy;
(b) your User Content;
(c) any goods you list or sell, or any conduct in the course of a transaction;
(d) your negligent, wilful, fraudulent or unlawful conduct.
This indemnity does not apply to the extent the loss was caused by Bundle's own negligence, wilful misconduct, or breach of these Terms.
17. Suspension and termination
We may suspend or terminate your access to the Platform where:
- You breach these Terms, the Privacy Policy, the Refund & Dispute Policy, or the Acceptable Use Policy
- We reasonably suspect fraud, misrepresentation, or unlawful conduct
- We are required to by law
- The Platform is discontinued
Where practicable we will give you reasonable notice and the reason. We may act immediately and without prior notice where the breach is serious, where we reasonably suspect fraud or unlawful conduct, or where we are required to act by law. Suspension or termination does not affect any refund or right that has already accrued to you under our Refund & Dispute Policy.
You may close your account at any time by emailing hello@letsbundle.online. Some clauses survive termination (including fees owing, indemnity, IP, limitation of liability, and dispute resolution).
18. Changes to these Terms
We may change these Terms from time to time. Material changes will be notified by email and on the Platform at least 14 days before they take effect. Continued use of the Platform after that period means you accept the changes. If you do not accept them, you must stop using the Platform and may close your account.
19. Dispute resolution
If you have a dispute with Bundle:
- Direct contact. Email hello@letsbundle.online describing the issue. We will respond within 5 business days and aim to resolve within 30 days.
- Good-faith negotiation. Both sides will attempt to resolve the dispute in good faith.
- Mediation. If unresolved after 30 days, the parties will attempt mediation through a mutually agreed mediator before commencing court proceedings.
- Courts. If the dispute remains unresolved, you and Bundle submit to the exclusive jurisdiction of the courts of New South Wales, Australia.
This clause does not prevent either party from seeking urgent injunctive or equitable relief, or from approaching a relevant regulator (e.g. NSW Fair Trading, ACCC, OAIC).
Disputes between Buyers and Sellers (as opposed to disputes with Bundle) are addressed in our Refund & Dispute Policy.
20. Governing law
These Terms are governed by the laws of New South Wales, Australia.
21. General
- Severability — if any clause is held invalid or unenforceable, the rest of these Terms remain in force.
- No waiver — failure to enforce a right does not waive it.
- Assignment — you may not assign your rights under these Terms without our consent. We may assign our rights on reasonable notice (e.g. in a sale of the business).
- Entire agreement — these Terms, with the Privacy Policy, Refund & Dispute Policy and Acceptable Use Policy, are the entire agreement between you and Bundle in relation to the Platform.
- Notices — notices to Bundle must be sent to hello@letsbundle.online. Notices to you may be sent to the email address on your account.
